1. Identification of website owner

Fundación Nueva Pescanova (hereinafter “Fundación NPVA” or ” Owner “), with address at Rúa José Fernández López, s/n, 36320, Chapela, Pontevedra, N.I.F. G-72496862 and registered in Rexistro de Fundacións de Interese Galego, Sección da Consellería do Mar, of the Xunta de Galicia with number 2023/2, is the owner of the website www.gssgaliciaforum.com (hereinafter, also called “Website”).

Use of the Website implies that you are a user of the website (hereinafter, the “User”) and implies acceptance of all the conditions included in this Legal Notice. The provision of the Website service is limited to the times at which the User is connected to the Website or to any of the services provided through it. Therefore, the User must read this Legal Notice carefully each time he/she intends to use the Website, as the conditions of use set out in this Legal Notice may be subject to change.

2. Purpose

By means of this Legal Notice, Fundación NPVA informs the Users of the Website about the conditions of use of the same.

This Legal Notice is applicable to those natural persons over 18 years of age, or legal persons, who access the contents of the Website and/or make use of the services provided on the Website. Minors under 18 years of age or incapable persons must use the Website under the full responsibility of their parents, representatives, or legal guardians, who must accompany, supervise or take the appropriate precautions during their browsing of the Website pages.

3. Access and use conditions

The User undertakes to:

• Use the Website in accordance with current legislation, this Legal Notice, respecting the intellectual property rights of the Owner or third parties, good customs, good faith and “netiquette”, i.e. the set of general rules of behaviour on the Internet;
• To make diligent use of the resources and not to carry out any action that causes damage or alterations to the contents or hinders the proper functioning of the Website, expressly undertaking by the sole use of the same not to cause technical problems of any kind, transfer elements likely to carry computer viruses or damage, interfere with or intercept all or part of the Website;
• Accept the terms and conditions of a specific service or resource when these are necessary, which will be explicitly required in each case;
• Not to make use of the Website outside the terms accepted by these conditions of use, specifically for illicit purposes, contrary to the law, morality, or public order in any of its expressions, or constituting a crime. Under no circumstances shall the User carry out actions that are offensive to the good name and image of the Owner , other Users of the Website or third parties.

In the event that comments, or opinion posts are allowed, the Owner shall not be responsible in any case for the opinions expressed by third parties, although it reserves the right to remove or even not publish those that are offensive or inappropriate or, failing that, when it has actual knowledge of the content of what has been published.

The Owner reserves the right to deny or withdraw access to the Website at any time and without prior notice to those Users who do not comply with these general conditions of use.

4. Intellectual and industrial property

Fundación NPVA or third parties own all the contents on the Website, including, but not limited to, the texts, photographs, links, industrial drawings, structure, images, designs, texts, graphics, audiovisual or audio content, buttons, elements constituting the object code, programming and engineering of the source code or any other signs susceptible of industrial and commercial use. All these elements, as well as the publications included, are protected by Spanish and European regulations on intellectual and industrial property and are subject to the intellectual and industrial property rights of the Owner and/or third party owners of the same, who have duly authorized their inclusion on the Website. Therefore, the User undertakes not to infringe any right derived from intellectual or industrial property, and the total or partial reproduction, public communication, distribution, or any form of exploitation of the same is expressly prohibited, except with the express written consent of Fundación NPVA.

The Owner or third parties are holders of the trademarks, logos, trade names or any other distinctive sign, being protected by the legislation on industrial property, it being understood that access to the Website does not grant the User any right over such trademarks, trade names and / or distinctive signs.

Any alteration, reproduction, adaptation, modification or public communication of all or part of the contents of the Website, carried out in any form or by any means, mechanical, manual, or otherwise, without the prior and express authorization of the Owner , is strictly prohibited.

No link may be established to this Website from any other website without the prior and express consent of the Owner . Any link to the Website must be directed to the “home” page, and it is forbidden to create deep links or links directed to other content other than the aforementioned.

Similarly, all operations on browse frames are prohibited.

The existence of links to third parties on the Owner’s website, unless expressly stated otherwise, are provided for information purposes, without the Owner having any control over the content or materials contained therein. Therefore, the Owner accepts no liability whatsoever for any damage or loss arising from their use. The Owner reserves the right to withdraw unilaterally and at any time the links that appear on its Website.

5. Owner’s responsibility

The Owner makes every effort to keep its Website updated so that the User can access it at all times and so that the Website does not suffer interruptions, but cannot guarantee the absence of technological failures, nor guarantee the permanent availability of the Website and the services contained therein. Consequently, the Owner shall not be liable for damages of any nature that may arise from, but not limited to (i) the lack of availability of the Website, access failures due to disconnections, breakdowns, overloads or failures of the network, internet, or other electronic systems, not attributable to the Owner, (ii) temporary suspensions of the Website, (ii) computer viruses or (iii) due to Force Majeure.

In the case of users who are minors or incapable, their parents, representatives or legal guardians shall be responsible for their access to the Website, products, services or content, or for their registration, and we therefore recommend that they be accompanied, supervised or take the appropriate precautions when browsing websites

6. Modification of the legal notice and suspension of the website

The Owner reserves the right to update, modify or delete this Legal Notice and the General Conditions of Use, its configuration, features and services at any time and without prior notice.

The Owner may, without prior notice, temporarily suspend the content of the Website for reasons of maintenance or repair of its systems and introduce the changes it deems appropriate in the same. The Owner excludes any liability for damages of any kind arising from the exercise of the powers defined in this section.

7. Communications and notifications

Communications and notifications by the User to the Owner must be made through the contact details indicated on the Website.

8. Protection of personal data

The treatment of the User’s personal data shall be governed in accordance with the provisions of Fundación NPVA’s privacy policy available here.

9. Invalidity of the clauses

If any content of this Legal Notice is declared totally or partially invalid or ineffective, by a final decision issued by a competent authority, such declaration shall only affect the content or part thereof that is invalid or ineffective, remaining in force the rest of the terms of this Legal Notice. In this case, such content, or the part of the same that is affected shall be deemed not to be in force, and the Owner shall make the relevant modifications in the shortest possible timeframe.

10. Applicable law and jurisdiction

This Legal Notice, as well as any relationship between the Owner and the User, is subject to Spanish law.

In general, any dispute that may arise in relation to this Legal Notice shall be submitted to the Courts and Tribunals of the city of Vigo, renouncing any other jurisdiction.
